1. Acceptance of these Terms

These Terms of Service ("Terms") form a binding agreement between you ("you", "user") and Big Helpers Software and Solutions Private Limited ("Big Helpers", "we", "us"), the operator of the service at links.bighelpers.in (the "Service"). By creating an account, accessing, or using the Service, you accept these Terms, our Acceptable Use Policy, our Notice and Takedown Policy, and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

The Service allows registered users to create, shorten, store, organise, and share hyperlinks and related content. We may add, change, or withdraw features at any time. We may set limits on usage, such as the number of links, request rates, or storage, and may apply stricter limits to new or unverified accounts.

Big Helpers acts as an "intermediary" under Section 2(1)(w) of the Information Technology Act, 2000. We store and transmit content that users submit. We do not initiate transmissions, do not select the receiver of a link, and do not select or modify the information contained in user links, except as needed for security, formatting, or to enforce these Terms.

We do not pre-screen or endorse user content. We are not responsible for third-party links, destinations, or websites that users create or share through the Service. Following any link is at your own risk.

5. Your content and your responsibility

You retain ownership of the content and links you submit ("User Content"). You are solely responsible for your User Content and for ensuring it is lawful. By submitting User Content, you confirm that:

Anyone can report a link or content that breaks these rules through the channel described in our Notice and Takedown Policy. We act on valid notices and on orders from a court or an authorised government agency.

We may, at our discretion and without prior notice, disable a link, remove content, throttle, suspend, or terminate any account that we reasonably believe violates these Terms, the Acceptable Use Policy, or the law, or that creates risk to the Service or other users. Where the law requires, we will act within the timelines set out in the Notice and Takedown Policy.

8. Intellectual property

The Service, including its software, design, branding, and the name Big Helpers, is owned by Big Helpers Software and Solutions Private Limited and protected by law. These Terms do not grant you any right in our intellectual property except the limited right to use the Service as permitted here.

9. Privacy

We process personal data in line with our Privacy Policy, which describes how we collect, use, retain, and protect your information under the Digital Personal Data Protection Act, 2023 and the rules made under it.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that links and destinations are safe.

To the maximum extent permitted by law, Big Helpers and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business, arising out of or related to your use of the Service or any User Content. Our total aggregate liability for any claim relating to the Service will not exceed INR 5,000.

You agree to indemnify and hold harmless Big Helpers and its directors, employees, and agents from any claim, demand, loss, or expense, including reasonable legal fees, arising out of your User Content, your use of the Service, or your breach of these Terms or the law.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access immediately if you breach these Terms or the law, or to protect the Service or others. On termination, the licences you granted end, except as needed for us to comply with the law or to retain records as permitted. Sections that by their nature should survive, including intellectual property, disclaimers, limitation of liability, indemnity, and governing law, will survive termination.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and change the "Last updated" date. Significant changes may be notified by email or in-product. Continued use after changes take effect means you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of India. The courts at Katni, Madhya Pradesh will have exclusive jurisdiction, subject to any right you have under applicable consumer law. Before starting formal proceedings, you agree to first raise the matter with our Grievance Officer.
